Safety Disclosure

By engaging the services of State of Safe (SOS), the Client acknowledges and understands that the services provided may involve the operation of unmanned aircraft systems ("UAS" or "drones") for the purposes of aerial photography, videography, inspections, mapping, marketing, content creation, documentation, and other related imaging services. State of Safe (SOS) is committed to conducting every operation with professionalism, safety, and compliance with all applicable federal, state, and local laws and regulations. All flight operations are performed only when the Pilot in Command determines that conditions are safe and legally permissible.

The Client understands that drone operations may require the aircraft to fly at varying altitudes and distances from surrounding objects depending on the objectives of the project. To capture requested imagery or video, the drone may operate close to buildings, walls, ceilings, roofs, windows, architectural features, landscaping, trees, equipment, vehicles, and other structures. Certain projects may involve indoor flight, low-altitude maneuvers, or precision flying in confined spaces. These operations are carefully planned and executed using established safety procedures; however, they involve the normal risks associated with operating an aircraft in close proximity to physical objects.

The Client further acknowledges that, depending on the nature of the project, drone operations may occur in areas where people are present or working. State of Safe (SOS) will make every reasonable effort to maintain a safe operating environment, communicate with affected individuals when appropriate, and minimize disruptions to normal activities. The Client agrees to cooperate in helping maintain a safe work area by informing employees, tenants, contractors, guests, or other occupants of scheduled drone activity when necessary and by following all reasonable instructions provided by State of Safe (SOS) personnel during flight operations. Individuals should avoid approaching the aircraft during launch, landing, or active flight unless specifically instructed to do so by the Pilot in Command.

The Client acknowledges that drones generate noise and airflow that may attract attention or cause temporary discomfort to some individuals or animals. Pets, livestock, wildlife, and service animals may react unpredictably to the presence or sound of a drone. Whenever reasonably possible, animals should be secured or relocated away from active flight areas prior to operations. The Client agrees to notify State of Safe (SOS) of any known animals or other site-specific conditions that could affect the safety of the operation. State of Safe (SOS) reserves the right to suspend, delay, or modify flight operations whenever the behavior or presence of animals creates a safety concern.

Drone operations are dependent upon environmental and operational conditions, including but not limited to weather, wind, precipitation, visibility, lighting, electromagnetic interference, signal quality, airspace restrictions, temporary flight restrictions, emergency activity, and unforeseen hazards. The Client understands that State of Safe (SOS) may postpone, relocate, modify, or cancel any portion of a project if, in the sole judgment of the Pilot in Command, conditions are unsafe, unlawful, or otherwise unsuitable for flight. Safety and regulatory compliance shall always take precedence over production schedules or requested shot lists.

The Client represents that they have obtained all necessary permissions and authorizations for State of Safe (SOS) to access and operate on the property or project site, including any approvals required from property owners, managers, tenants, homeowners' associations, or other responsible parties. The Client further agrees to disclose any known hazards, restricted access areas, security procedures, overhead utilities, sensitive equipment, hazardous materials, construction activities, or other conditions that may impact the safe performance of drone operations.

While State of Safe (SOS) utilizes professional-grade equipment, conducts thorough pre-flight planning and inspections, and follows recognized aviation safety practices, the Client acknowledges that the operation of any aircraft carries inherent risks that cannot be completely eliminated. By authorizing services, the Client acknowledges these inherent risks, agrees to cooperate with all reasonable safety procedures established by State of Safe (SOS), and understands that the Pilot in Command retains exclusive authority over all operational decisions, including whether a flight will commence, continue, be modified, or be terminated. Any request or instruction from the Client that, in the judgment of the Pilot in Command, would compromise safety or violate applicable laws or regulations will be declined.

By signing this Agreement or otherwise authorizing services, the Client confirms that they have read and understood this General Disclosure and Safety Notice and agree to cooperate with State of Safe (SOS) in maintaining a safe, lawful, and professional operating environment throughout the duration of the project.
